Noah Tourism (hereinafter: “the company”) would like to draw the attention of its customers to the information detailed below, which is an integral part of the order, and which, together with the order details, constitutes the car rental contract between the company and the customer.

Receiving the booking voucher and using it by renting a car from the car supplier constitutes the customer’s agreement to all the conditions stated above. It is clarified that the use of the vehicle is the sole responsibility of the customer, and that the company will not be liable for any damage, expense or loss incurred by the customer or any third party (including the vehicle’s passengers) as a result of its use.

The information provided to the company by the vehicle suppliers is the responsibility of the supplier, and it may change from time to time even without prior notice.

Car Rental Contract: The customer’s contract with the company is for the purpose of ordering a car from a car supplier in the destination country (above and below: the “Supplier”). The company’s role is limited to brokerage services and creating a connection between the customer and the supplier in the destination country. When picking up the vehicle, the customer will sign a new contract in his capacity as the car renter (hereinafter: the “renter”) with the supplier, with the company not being a party to the said agreement. From the date on which the customer became the “car renter”, the company has terminated its role, and from this date onwards the supplier will be responsible for everything related to the car rental, and the terms of the car rental contract will apply to all relations concerning the rental vehicle, and the company will be exempt from any liability towards the customer and/or anyone on his behalf, including but not limited to, in cases of breach of the rental agreement by the supplier, as well as in cases of an act or omission by the supplier or anyone on his behalf.

The rental of the vehicle is for personal purposes only, and the vehicle may not be used for commercial or business purposes. Before signing the rental agreement, the customer must ensure that the details of the agreement and the addenda thereto are completely clear to the renter and that they are agreed upon, and if not, explanations and clarifications must be obtained from the car supplier. A copy of the car rental agreement and the vehicle return documents must be kept, in case of any inquiry. It is clarified that the renter’s signature on the car rental contract is binding and cannot be canceled retrospectively.

Requests for deposit refunds and inquiries about charges such as reports and toll rates will be made directly with the rental company and not through Noah Tourism.

At the rental station abroad, each driver must present as a condition for receiving the vehicle: a printed car rental voucher, a valid passport in the name of the renter, a permanent Israeli driver’s license (with photo) in the name of the renter, together with an international driver’s license in the name of the renter, which are valid and have identical details, a valid international credit card in the name of the renter, exactly as it appears in the passport, in order to guarantee payments and/or obligations that he will be obligated to make according to the car rental contract with the car supplier abroad, in addition to the car rental fees included in the voucher. The credit card will serve as a deposit to the car rental company in the amount of the deductible as listed on the rental voucher, in addition to additional charges that may apply to the car rental transaction, such as fuel costs, additional drivers, various equipment, etc. Most important: You must ensure in advance that the credit limit on the credit card is sufficient to provide the deposit, and take into account that the deposit is at the expense of the customer’s credit limit.

It is important to know the credit card’s PIN number, as the code must be entered when making the transaction. The vehicle supplier will not accept cash, checks, or any other means of payment other than a credit card as a deposit or payment method. It is not possible to use an electronic credit card or DEBIT CARD, or cards that the supplier, in its sole discretion, determines are not honored by it.

For certain vehicle groups, 2 credit cards may be required as a condition for renting the vehicle. It is clarified that presenting an international driving license in conjunction with a valid Israeli driving license and a credit card as stated above to the supplier is a necessary condition, and the failure of the customer to meet the conditions required by the supplier may result in the supplier not making the vehicle available to the customer. For the sake of good order, the customer will not have any claim or demand against the company in this regard. The vehicle reservation voucher is valid only for the customer of the vehicle, for the destination station of vehicle pickup, for the date and time appearing on it, for the destination station of vehicle return and other details of the reservation voucher.  

The reservation is valid with reference to the details appearing on the voucher. If the information is not correct or accurate, there is no obligation to provide the vehicle, and therefore the customer must check this in advance and before leaving the country. The time the vehicle is made available to the customer is only an estimate. The vehicle will be kept for the customer until one hour after the delivery time indicated on the voucher, or until the station closes (whichever comes first). Please note that the station’s operating hours may vary from country to country and city to city, among other things, depending on local events and holidays.  

Failure to arrive at the supplier’s station, for any reason, may be considered a cancellation of the voucher, as detailed below. The minimum age of the renter is generally 21 (although certain vehicle groups will require a minimum age of 25 years) with a driving license of at least 12 months. Any additional driver in addition to the renter who wishes to drive the vehicle and meets the seniority and age requirements must present a passport and an Israeli and international driving license, and his details must be added to the vehicle rental contract. In certain countries, an additional fee may be charged for an additional driver. A rental day is 24 hours. The rental days appearing on the voucher cannot be split into separate rentals. No refund will be given for partial use of the voucher. Late return of the vehicle, or extension of the rental beyond the number of days indicated on the voucher, will be charged an additional fee according to the local price list of the vehicle supplier (which may differ from the price list based on which the reservation was made), plus local mandatory insurance and payments.

Various suppliers around the world have car rental policies that include, among other things, rules regarding refusal to rent a car, which they change from time to time at their discretion. In the event of a supplier’s refusal to rent the vehicle to the customer, the Company will not be responsible for providing the customer with an alternative vehicle from another supplier and/or compensating the customer for any damages that may be incurred, and the customer hereby releases the Company from any such liability.

The rented vehicle: The type of vehicle, model, year of manufacture, engine capacity, trunk size and fuel type specified in the voucher are not guaranteed and may change, at the discretion of the supplier, as is customary and customary in the field, and the customer will have no claim or demand in this regard. It is clarified that the vehicle supplier may provide the customer, depending on the availability of inventory in its possession, with a vehicle defined by the vehicle supplier as being of equal or equivalent value, or from a higher group. If it is not specified in the booking voucher next to the vehicle type that the vehicle is an automatic vehicle, the default is a vehicle with a standard transmission and not an automatic one.

The responsibility for inspecting the condition of the vehicle upon delivery applies solely to the renter. It is clarified that if and when the vehicle is returned, any defects or damage to the vehicle are found that were not reported to the supplier at the time of rental, the customer will be deemed responsible for these damages, with all that this implies. Therefore, if and when the inspection carried out by the customer before taking the vehicle reveals any damage, the supplier must be notified immediately and ensure that this is recorded by him.

The company recommends that the customer check the tools in the vehicle upon receipt of the vehicle, as well as the warning triangle, a high-visibility vest, and tools for replacing or repairing a flat tire. A vehicle may be supplied with a spare tire or only with an inflation kit, or there may be other procedures in the event of a flat tire that must be clarified upon receipt of the vehicle. Without detracting from the generality of the foregoing, in any event of an accident or other damage to the vehicle, including mechanical malfunctions, the customer is required to immediately notify the supplier and receive their instructions for continuing the journey and use of the vehicle. In the event of an accident, the police must also be notified and act in accordance with their instructions.

Pay attention to the details below:

Smoking in the vehicle is strictly prohibited. Anyone who violates this prohibition is subject to a fine. The vehicle must be returned to the rental company in good and clean condition as received from the rental company. A vehicle returned in a condition that requires special interior cleaning will be charged the cleaning fee at the discretion of the rental company.

Fuel: The vehicle is usually delivered with a full tank of fuel and the renter must return it in the same condition. A fee will be charged for a lack of fuel in the tank at a rate determined by the vehicle supplier, plus fueling fees as is customary with the vehicle supplier. It is recommended to keep the latest fueling receipt and request that the vehicle return report detail the fuel level in the tank in case of any inquiry regarding this matter. Filling the vehicle with fuel contrary to the manufacturer’s and vehicle supplier’s instructions will result in the renter being charged up to the full cost of the repair. In certain countries, vehicle suppliers offer a service that allows the vehicle to be returned with a missing fuel tank. This service is offered for a prepayment and the customer’s signature on it is binding and cannot be canceled.

Rental terms and insurance:

Rental and insurance terms vary from country to country and from vehicle supplier to vehicle supplier. The various insurance policies and specific insurance terms offered by vehicle suppliers are determined by the vehicle suppliers and are not the responsibility of the company. The customer should note that most insurance policies do not include insurance for the property in the vehicle.

The customer must ensure that the insurance meets his needs, and that he understands the exclusions, limitations and conditions set for activating the policies, if required. In the insurance policies used by rental companies, there is a deductible in every case of damage and theft. This deductible cannot be canceled in all CDW or TP insurances and will be charged in any case, even if the damage was caused by a third party or through no fault of the renter. In all insurances, unless otherwise expressly stated in the voucher, an initial deductible applies to the renter of the vehicle. The details of the deductible and its amounts must be clarified in advance. The validity of insurance for canceling the deductible abroad is conditional on compliance with the terms of the rental contract between the renter of the vehicle and the vehicle supplier abroad, as well as compliance with the provisions of local traffic laws.

For the avoidance of doubt, it is hereby expressly clarified that all insurances are valid and conditional on the terms of the car rental contract not being violated. Traffic laws vary from country to country, and the vehicle renter and the driver on his behalf are obliged to inquire about these laws in advance and act in accordance with them. For the avoidance of doubt, the Company is not responsible for any expense, damage or loss that may be incurred by the renter due to failure to observe these laws or their violation, and for the sake of good order, reports, fines and penalties that may apply in such cases will apply to the renter only, without him having any claim against the Company or anyone on its behalf. In certain countries, driving in violation of traffic laws (speeding violations, etc.) will be considered a violation of the car rental contract, and in such a case the insurance will not be valid. Deductible reimbursement insurance is made with an external insurance company and is subject to actual payment of the deductible to the vehicle supplier abroad and compliance with the insurance terms detailed in a separate insurance appendix between the insurance company and the customer. The insurance terms in the car rental contract should be checked and, if necessary, clarifications should be obtained from the car supplier’s representative. The renter should be careful to sign only after verifying the insurance terms and finding them to his satisfaction and after verifying that the details he requested were recorded in the rental contract.

The insurances in any case do not cover damage to the clutch, upholstery, special cleaning that will be required for the interior of the vehicle, and damage caused as a result of driving while drunk or under the influence of drugs, negligent driving or intentional or malicious damage, driving on unpaved areas, natural damage, leaving the key in the car unattended and /or loss of a key, damage as a result of incorrect fuel filling and/or as a result of fuel freezing, etc.’

Any damage caused to the vehicle during the rental period must be reported immediately to both the local police and the vehicle supplier, ensure that a report is received and act according to their instructions.

If the damage is caused by the renter’s negligence, or in any other situation where the car supplier’s insurance coverage is exceeded, the renter will be responsible for all damages caused to the car supplier.

Upon receipt of the vehicle and signing the vehicle rental contract, the vehicle supplier may offer additional insurance to expand the insurance coverage. The customer renting the vehicle must inquire about the details of the additional insurances he is signing (beyond those indicated on the voucher). If the renter chooses to purchase these insurances, he will bear an additional charge in accordance with the vehicle supplier’s price list.

It will be clarified that the above does not constitute insurance advice by the company.

Movement and travel restrictions:

Before signing the rental agreement, it must be ensured that the vehicle renter is not subject to any restrictions on entry and/or travel to other countries, crossing via ferries, etc., traffic restrictions and prohibitions, violation of which will result in the cancellation of the insurance. If the route of travel passes through snowy or difficult roads, the renter must ensure that appropriate equipment for the vehicle is ordered in advance (winter tires and/or snow chains), subject to the procedures of the rental companies, the car suppliers abroad, and the laws of the country.

Extras not included in the rental voucher (unless otherwise expressly stated in writing on the voucher): Airport tax, additional driver insurance, young driver insurance (21-25), state taxes, environmental taxes, etc., passenger and baggage insurance (PAI) or any other insurance not expressly stated in the booking voucher, refund fees, traffic fines, parking fees, road tolls and government or municipal levies (baby seat or child seats, winter equipment, ski equipment or any extra that the renter signed in the car rental contract. The availability of the aforementioned extras may change from time to time, and the company will not be liable to the renter in cases where at the time of signing the rental agreement, the required extras are not available to the renter. Any charges abroad for extras will be collected in addition to local taxes, levies and mandatory payments. All prices for extras are estimated amounts only, and they do not bind the company since they are subject to change. By the vehicle supplier abroad without prior notice. If and to the extent that it is agreed between the customer and the supplier that the supplier will provide the customer with additional services or additional equipment beyond those appearing in the voucher issued by the company, the customer will bear all costs involved, in accordance with the supplier’s terms.

The company is not responsible for the data in the GPS device provided by the rental company and is not responsible for the use of the device or for direct and/or indirect results resulting from the use of the device. The use of the device is at the sole responsibility of the user and it is recommended to clarify the software data and the method of using the device with the rental company at the time of receipt of the ordered vehicle. It is clarified that different devices operate in different ways and sometimes local and/or technical information is required to operate the device correctly, and thus the company will not be able to assist. In any case, the company’s position is that the device is an auxiliary tool and does not supersede the use of a local map. There are different types of navigation systems and it is not possible in any case to commit to a specific type of navigation system. The maps in the navigation system are usually adapted to the place where the vehicle was picked up only. The renter is responsible for returning the system in good condition and all its parts. In any case, the renter is obliged to clarify the terms of renting the navigation system with the vehicle supplier directly before renting it.

WI-FI HOT SPOT

The company is not responsible for the data on the FI-WI device or for its use, and this is done solely at the user’s risk. In any case, the renter is obliged to clarify the terms of renting the device with the vehicle supplier directly, before renting the vehicle.

Additional conditions:

Any verbal commitment and/or promise for a refund given abroad does not bind the Company, and it is not responsible for the refund of expenses abroad, such as: hotels, trains, flights, more expensive car rentals, etc., if prior written approval of the Company for the financial expense is not received. The Company does not serve as an agent, branch or representative of the vehicle supplier, and it is not a party to the rental agreement between the renter and the vehicle supplier abroad, and is not responsible for the fulfillment of the terms of the vehicle rental agreement by the vehicle supplier and/or for any act or omission of the vehicle supplier or anyone on its behalf.

However, the company will try to assist during the entire rental period of the car and after it, in clarifying requests and/or claims against the car supplier, and this to the extent that the customer contacts it.

Voucher cancellation fees:

Subject to the provisions of any law, the cost of cancellation fees to be borne by the orderer are:

–  15 euros + value added tax after issuing a voucher only.

–  50 euros + value added tax if the car is not taken without prior cancellation notice – SHOW .NO

Notwithstanding the above, there are cases in which higher cancellation fees will apply, in accordance with the cancellation policies of the various providers. Therefore, the Company reserves the right to change or update, from time to time, temporarily or permanently, the aforementioned cancellation fees, and the Clients will have no claim or demand in this regard.

A request to cancel or change an order will be sent in writing to the company.

Please note that the voucher is personal and non-transferable, except with the consent and approval of the company and the supplier in advance and in writing, and under conditions to be determined by them.

The limits of the company’s liability

The Company, its employees, managers or anyone on their behalf shall not be liable for any damage and/or loss and/or expense, including indirect, consequential, special or apparent damage, including loss of income and/or profits, incurred by the Customer and/or a third party in connection with or as a result of the use of the vehicle and/or as a result of the Supplier’s breach of the rental agreement. Without derogating from the generality of the foregoing, it is clarified that in any case the Company’s liability towards the Customer or anyone on his behalf (if and to the extent any) will be limited in aggregate to an amount equal to the amount paid by the Customer to the Company as part of the rental transaction.

Disputes and Jurisdiction:

The company is not the address for receiving legal claims against the supplier. In any case of dispute between the customer and the supplier, the provisions set forth in the rental agreement will apply, including with regard to the place of jurisdiction and applicable law.

In any case of a dispute between the client and the company, the jurisdiction to clarify these disputes will be given to the courts in the city of Cape Town only.
